Terms of Service
These terms govern your use of TouchGrass and every booking you make through it. By registering for an event, tournament or open game - as a signed-in user or as a guest - you accept them. Please read clause 7 in particular: sport carries a risk of injury, and you take that risk on yourself.
Who we are
TouchGrass is a sports community platform operating in Nashik, Maharashtra, India. We organise and list football matches, cricket tournaments, badminton events and pickup games, and we take payment for entry to them.
Throughout these terms, “TouchGrass”, “we” and “us” mean TouchGrass, whose address and grievance contact are set out at the end of these terms. “You” means the person using the platform or attending an activity booked through it.
Accounts and guest bookings
You can book as a guest with only a name, email address and phone number, or you can create an account. Accounts are managed through our authentication provider, Clerk.
You are responsible for the accuracy of the details you give us. We use them to issue your entry pass, to reach you if an activity changes, and to identify you at check-in - so an incorrect phone number or email may mean you do not receive your pass or a cancellation notice.
- You must be at least 16 years old to book on your own behalf. If you are under 16, a parent or guardian must book for you and attends as your responsible adult.
- One person, one booking. Do not book on someone else's identity, and do not resell an entry pass.
- Keep your account credentials to yourself. Anything done through your account is treated as done by you.
Bookings, entry passes and capacity
A booking is confirmed only once payment is captured and we have issued you a digital entry pass. Until then your slot is not held. Activities have a fixed capacity and are allocated first come, first served.
If an activity is full you may be able to join a waitlist. A waitlist place is not a booking. If a slot is released we notify you and hold it for a limited claim window; if you do not claim it in that window it passes to the next person.
Your entry pass is what admits you. Bring it, and be ready to be checked in against it at the venue.
Prices, payment and tax
Entry fees are shown in Indian Rupees and are inclusive of all applicable charges unless stated otherwise on the activity page. The price shown at the moment you pay is the price that applies.
Payments are processed by Razorpay. We do not receive or store your card number, UPI PIN or bank credentials - those go directly to the payment gateway. We store only a payment reference so we can match your booking to your payment and process a refund if one becomes due.
TouchGrass is not currently registered for GST, and accordingly does not collect any amount by way of GST on entry fees. Should we become registered, tax will be shown as a separate line before you pay and reflected on your invoice.
- Discount coupons, where offered, are single-use unless stated otherwise and may be withdrawn at any time before they are applied to a booking.
- We issue an invoice for every paid booking, available from your booking record.
- If a payment is captured but no entry pass is issued, contact us - we will either issue the pass or return the money in full.
Cancellations and refunds
Cancel a confirmed booking and 80% of your entry fee is returned, with 20% retained against the slot you released. If TouchGrass cancels an activity, you are refunded in full, automatically, with no fee.
This is set out in detail in our Refund Policy and Cancellation Policy, which form part of these terms.
Player-created open games
Some activities on TouchGrass are open games created by players rather than organised by us. These enter a moderation queue and are published only once approved, but approval is a check on listing quality - it is not a warranty about the venue, the organiser or the other players.
If you create an open game you are responsible for the accuracy of what you list, for having the right to use the venue you name, and for conducting yourself as an organiser in good faith. We may unpublish any listing at any time.
Assumption of risk, health and conduct
Sport carries an inherent risk of injury. Football, cricket and badminton involve physical contact, sudden movement, hard surfaces and equipment travelling at speed. By attending an activity booked through TouchGrass, you accept that risk voluntarily and take part at your own risk.
You confirm that you are medically fit to take part in the activity you have booked, and that you will stop if you become unwell. If you have a condition that could be affected by strenuous exercise, get medical advice before you book.
We strongly recommend that you hold your own accident and health insurance. TouchGrass does not provide personal accident cover for participants.
- Follow the instructions of the match coordinator, referee or venue staff at all times.
- No abuse, harassment, discrimination, violence or intimidation - towards players, officials, staff or venue neighbours. We remove people for this without a refund.
- Do not attend under the influence of alcohol or drugs.
- Wear appropriate footwear and equipment for the surface and the sport. Some venues prohibit metal studs.
- You are responsible for any damage you cause to a venue or its equipment.
Photography at activities
We may photograph or film activities for use on TouchGrass and our social channels. If you would prefer not to appear, tell the match coordinator at the venue or email us, and we will not use footage that identifies you.
Our liability
We provide the platform and organise activities with reasonable care and skill. We do not, however, exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, and to the fullest extent permitted by law, our total liability to you in connection with any activity or booking is limited to the amount you paid us for that booking. We are not liable for indirect or consequential loss, for loss of enjoyment, or for travel or accommodation costs you incur to attend.
We are not liable for the acts of other participants, for the condition of a third-party venue, or for events outside our reasonable control - including weather, power failure, civic restrictions and venue withdrawal. Where such an event forces a cancellation, the Cancellation Policy governs what happens to your money.
Suspension and removal
We may suspend or close your account, refuse a booking, or remove you from an activity if you breach these terms, if you behave in a way that puts others at risk, or if we reasonably suspect fraudulent payment activity. Where we do so for a breach on your part, no refund is due.
Intellectual property
The TouchGrass name, marks, site design, written content and photography belong to us or to our licensors. You may not copy, republish or use them commercially without our written permission. You keep ownership of anything you submit, and grant us permission to display it where doing so is necessary to run the platform.
Changes to these terms
We may update these terms. The effective date at the head of this page tells you when the current version took effect, and the version in force when you made a booking is the version that governs that booking. Material changes will be notified by email to account holders where we hold a valid address.
Governing law and disputes
These terms are governed by the laws of India, and the courts at Nashik, Maharashtra have exclusive jurisdiction over any dispute arising from them.
Before going to court, please write to us at the grievance address below. Most disputes are resolved quickly once someone has looked at the booking record.
